1 – Accepting our Terms and Conditions

1.1       COC is offered to you conditioned on your acceptance without modification of our terms and conditions contained herein. Your use of COC constitutes your agreement to all such terms, conditions and notices.

2 – Terms of offers

2.1       If for any reason the external websites(s) advertised by COC decides to reduce our commission rate at a later date for any reason, this could mean a variation of the initial cashback deal offered to you. Providing we are informed of such change as well, we will endeavor to update the cashback offer on COC website as soon as we can and we will inform you of any changes.

2.2       It is your responsibility when signing up to an online casino to make sure that you adhere to the terms and conditions of that company, and are not contravening any rules/laws in the territory/state/country (in which you are resident) have governing an account such as age or legality to wager on line.

2.3       If for whatever reason a casino offering cashback via our programs defaults on its agreement to pay our commissions, COC shall not be liable for any outstanding cashback monies (including any outstanding monies or prizes for previous or current promotions, including but not limited to exclusive promotions, cash/prize etc) owed to the player by that merchant.

3 - Fraudulent activities with the merchant

3.1       All merchants have the right to withhold affiliate commission payments in the event they believe that there is reason to believe that a player is using their account for fraudulent purposes.

3.2       In the events stated under 3.1 merchants can refuse to release commissions to COC. Whilst these occurrences are few and far between, they are nonetheless possible and such player/s may be required by the casino company to pay such amounts withheld.

3.3. In those situations as stated under 3.1 and 3.2 any cashback due to the player will be voided and COC will exit from any relationship with player/s involved in such fraudulent activities.

4 – Cashback reports and discrepancies

4.1       COC depends on reports from the casino companies in order to calculate the amount of cashback generated by players. The net revenue numbers we receive from the casinos at the month end are subject to change by the merchant on account of extra/missing data, fraud and chargebacks.

4.2       The month end reports that we get from merchants are final and COC is unable to enter into any discussion with any casino company on reporting issues.

4.3       If you feel that the amount of net losses you have generated in any given month is incorrect, COC will provide you details of the report received by the merchant and you will need to consult the merchant directly if you wish to discuss discrepancies.

4.4       In order for a player to receive payments, COC need to access reports from the casino company are affiliated with us. These reports in the various forms show some, or a combination, of the following information: player name, player email, player ID number, revenue generated in a given month, overall Revenue generated with merchant. By signing up through COC with any casino company, you are granting us permission to view these reports and are also granting permission for the respective casino company to allow us access to see said reports and the information contained therein.

5 – Payment of Cashback to players

5.1       COC is able to offer you cashback bonuses as we may receive a commission when you purchase a product and / or register your account with a gambling operator via links published on COC website.

5.2       If a merchant declines payment of our commission, is late in paying COC our commissions or withholds payment of our commissions for any reason COC reserves the right to withhold payments of cashback due to you as a result of a purchase of a product supplied by that merchant until we receive our commission.

5.3       There may be a number of players who register with a particular merchant through COC. If one player wins money one month, and you lose money, the aggregate amount will be the relevant figure which will be used by the merchant to calculate the commission owed to COC. Therefore, if you lose money you may not be entitled to a cashback in a particular month because another player has won. For example, if Player A wins £1000 with Casino 1, and Player B loses £500 with the same Casino, Casino 1 has a total loss of £500, so will not pay out any commission to COC. Player B would lose the right to receive any cashback because Casino 1 has made a loss through COC.

5.4       All cashback payments are transferred by COC to the user’s chosen payment option account via Neteller, Paypal or Skrill (former Moneybookers). These monies are usually paid on or before the 18th of the following month (providing the user has selected a valid payment method).

5.5       It is the player’s responsibility to submit his/her Cashback Submission form immediately after the registration with the merchant chosen as cashback payments related to previous months will not be available. The Cashback Submission form is available on our website from the main page related to the casino brand.

5.6       The player is entitled to receive cashback commissions according to the confirmation email sent by COC. Late Cashback Submissions may imply delayed or missed cashback payments (as mentioned under 5.5).

5.7 In order to avoid delays in receiving cashback commissions the players is advised to complete the cashback submission as follow:

Step 1: To choose a merchant available from COC.

Step 2: To register a new player account with the merchant via COC affiliate links.

Step3: To complete and submit the “cashback submission form” which is available from the COC page dedicated to the merchant.

Step 4: COC will confirm if via email if the “Step 2” was completed successfully.

6 – Multiple Accounts

6.1       There is strictly only one COC account allowed per person, per household.

6.2       We monitor account usage closely and if COC detect any activity to suggest a user is attempting to abuse the incentive schemes offered by COC by impersonating or assuming the identity of another user in order to benefit from the referral scheme, or as a way to hold multiple accounts, or for any other reason including where COC believe accounts have been managed by the same individual or group of individuals, COC reserve the right to freeze all accounts we believe to be involved in the activity and suspend and/or decline all cashback due payments associated with those players.

6.3       COC reserve the right to suspend, decline or terminate without prior notice any due cashback payments, or to withold or void any payments if COC believe that you are abusing the cashback schemes or engaging in fraudulent activity. Our decision is final.

6.4       The player is allowed to open accounts with more than one merchant through COC. In this occasions net losses generated by the player are combined and if possible negative balances will be offset against positive ones.

6.5       If a player signs up for casino cashback offer and also chooses to play at Poker room’s available by the same merchant (if it has one) they will not be entitled to rakeback on any rebate of rake or losses they occur at the poker site.

7 – High roller policy

7.1       In any given month, if the total winnings in that month is positive (+) $2,000 or higher, then that player shall be deemed by Cashback Online Casino to be a ‘High Roller’ and the High Roller Policy will apply.

7.2       If the above High Roller criteria is met (stated within 7.1), the net winnings generated by the ‘High Roller’ will generate a negative cashback balance which is carried forward and offset against future positive cashback generated from the net losses by the ‘High Roller’.

7.3       The “High Roller” can receive cashback from COC only once his/her overall total cashback is positive (+). For High Roller players, negative cashback generated by the net winnings is carried forward and not automatically reset to zero at the beginning of each calendar month. Once his/her overall total cashback is positive (+) the High Roller will receive cashback on or before the 18th of the following month (providing the user has provided details of a valid payment method).

7.4       The maximum cashback amount per calendar month paid by COC to each High Roller is USD 10,000 or its currency equivalent.

8- Changes of cashback deal

8.1       COC shall use reasonable endeavours to inform the player

of any changes to a cashback program by a casino company, but in the event that COC has not been able to inform the player of any changes it is the new terms of the cashback program that shall apply.

8.2       COC shall not be liable for any change of cashback program or loyalty scheme by a casino company which results in any loss of income for any player regardless of whether or not the player was adequately informed of said change by either the merchant or COC.

9 –Conditions of use

9.1       As a condition of your use of the COC website, you warrant to COC that you will not use our website for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the COC website in any manner which could damage, disable, overburden, or impair the COC website or interfere with any other party’s use and enjoyment of the COC website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the COC website.

9.2     If any provision or part-provision of the contract is or become invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision of part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of the contract.

9.3     If one party (COC or the customer) gives notice to the other of the possibility that any provision or part-provision of this contract is invalid, illegal or unenforceable, the parties shall negotiate in good faith to ament such provision so that, as amended it is legal, valid and enforceable, and, to the greatest extent possible, achieves the intended commercial result of the original provision.

9.4     Nothing in the contract is intended to, or shall be deemed to, establish any partnership or joint venture between the parties, nor constitute either party the agent of the other for any purpose. Neither party shall have authority to act as agent for, or to bind, the other party in any way.

9.5     A person who is not a party in the contract shall not have any rights to enforce its terms.

9.6     Except as set out in these Conditions, no variation of the Contract, including the introduction of any additional terms and conditions, shall be effective unless it is agreed in writing and signed by COC.

Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this contract or its subject matter or formation.
